Terms of Service

These terms govern your use of the website at topndisaustralia.com.au and related services (the “Platform”), operated by TLY Investments Pty Ltd (ACN 677 990 617), trading as TopNDISAustralia (“TopNDISAustralia”, “we”, “us” or “our”). By accessing or using the Platform, you agree to these terms. If you do not agree, please do not use the Platform.
What we provide
TopNDISAustralia is an independent online directory of Australian NDIS providers, backed by verified reviews from participants, families and carers, and merit-based recognition. We are a directory and software platform only. We are not an NDIS provider, we do not deliver supports or services, and we are not a party to any service agreement, quote, or engagement between a participant and a provider. We do not arrange, supervise, guarantee, or take responsibility for any support or service delivered. We are not affiliated with, endorsed by, or connected to the National Disability Insurance Agency (NDIA) or the Australian Government.
Eligibility & accounts
You must be at least 18 years old and able to enter into a binding contract to use the Platform. If you create an account, you are responsible for keeping your login details secure and for all activity under your account, and you agree to provide accurate, current information.
For participants, families and carers
Searching the directory and submitting enquiries is free. When you submit an enquiry, your details are passed to the relevant provider so they can contact you — we do not guarantee that a provider will respond, or the price, quality, timing or outcome of any support or service. You are responsible for your own decisions: always confirm a provider’s registrations, insurance, qualifications, screening checks and references before engaging them. Any service agreement with a provider is solely between you and them.
For providers & listings
- Listings may be created from publicly available information. You can claim your listing to manage it.
- You are responsible for the accuracy of your listing, and you confirm that you hold all registrations, qualifications, screening checks and insurance required to deliver your services lawfully.
- By adding content to your profile, you grant us a licence to display it on the Platform.
- Listed businesses must be genuine, active, Australian-based providers of disability supports or services.
- We may edit, suspend or remove any listing that breaches these terms or misrepresents a business.
Reviews
Reviews must be honest, first-hand accounts of your own genuine experience. You must not post fake, incentivised, misleading, defamatory, offensive or unlawful reviews, or reviews about your own business or a competitor. We verify reviews by email before they are published, and we may moderate, decline or remove any review at our discretion. You are responsible for the content you submit, and you grant us a licence to publish it. Providers may publicly respond to reviews on their profile.
Credentials & verification
Verification features (such as ABN or NDIS registration checks) are provided as a convenience and rely on third-party data sources. We do not guarantee that any verification, badge or credential is accurate, current or complete, and it is not a substitute for your own checks before engaging a provider.
Recognition
Recognition rankings are calculated by our algorithm using verified reviews. Recognition is based on merit — we do not sell or accept payment for recognition placements, and paying for a subscription does not affect recognition rankings. Recognition decisions are final, though you may raise a concern by contacting us.
Subscriptions & billing
- We offer a free listing and paid plans (Pro and Premium). Paid plans are billed monthly or annually through our payment processor, Stripe.
- Paid plans renew automatically until cancelled. You can cancel at any time; cancellation stops future billing and your plan remains active until the end of the current paid period.
- Except where required by the Australian Consumer Law, fees are non-refundable, including for partial billing periods.
- We may change our prices or plan features with reasonable notice. We charge flat subscription fees only — we do not charge per-lead or commission fees.
Acceptable use
You agree not to: scrape, harvest or bulk-export data from the Platform; attempt to circumvent our verification or moderation systems; use the Platform unlawfully or to harass, defame or harm others; impersonate any person or business; introduce malware; or interfere with the operation or security of the Platform.
Intellectual property
The Platform, including its design, branding, text and software, is owned by us or our licensors and is protected by law. We grant you a limited, non-exclusive licence to use the Platform for its intended purpose. Content you or a provider submit remains yours, but you grant us a licence to host and display it in connection with the Platform.
Third-party services
The Platform relies on, and may link to, third-party services (such as Stripe for payments). We are not responsible for the content, products or practices of third-party services, which are governed by their own terms.
Disclaimers
The Platform is provided “as is” and “as available”. To the extent permitted by law, we do not warrant that the Platform will be uninterrupted or error-free, or that any listing, review, rating, credential or other information is accurate, current or complete. Reviews are the opinions of the people who post them and do not reflect our views. We do not warrant the quality of support, conduct, registration status or availability of any provider.
Your rights under the Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law or other laws that cannot lawfully be excluded. Where our liability for failing to comply with a consumer guarantee cannot be excluded but can be limited, our liability is limited (at our option) to re-supplying the relevant services or paying the cost of re-supply.
Limitation of liability
To the maximum extent permitted by law, and subject to the section above, we are not liable for any indirect, incidental, special or consequential loss, or for any loss arising from your dealings with a provider or participant. To the extent we are liable, our total liability to you is limited to the amount you paid us (if any) in the 12 months before the event giving rise to the claim.
Indemnity
You agree to indemnify us against any claims, losses or costs arising from your breach of these terms, your misuse of the Platform, or the content you submit, to the extent permitted by law.
Suspension & termination
We may suspend or terminate your access to, or a listing on, the Platform if you breach these terms or where reasonably necessary to protect the Platform or its users.
Changes to these terms
We may update these terms from time to time. The current version will always be available on this page. Your continued use of the Platform after changes take effect constitutes acceptance.
Governing law
These terms are governed by the laws of the State of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
